JECHONIAS G MANZANO V. SANDIGANBAYAN AND PEOPLE OF THE PHILIPPINES
Sirs/Mesdames:
Please take notice that the Court, Second Division, issued a Resolution dated 11 August 2010 which reads as follows:
G.R. No. 147242 (Jechonias G Manzano v. Sandiganbayan and People of the Philippines). - This treats of the petition for certiorari with prayer for the issuance of a temporary restraining order and/or writ of preliminary injunction dated March 14, 2001 filed by Jechonias G. Manzano. The petition seeks to nullify the Resolutions of the Sandiganbayan dated January 24, 2001[1] and February 27, 2001[2] which directed the suspension pendente lite of petitioner and his co-accused Lory L. Lambot. Petitioner, Lambot and a certain Buenaventura Aro, in their respective capacities as Mayor, Vice-Mayor and Treasurer of the Municipality of Candoni, Province of Negros Occidental were charged before the Sandiganbayan of malversation of public funds as defined and penalized under Article 217 of the Revised Penal Code. The case was docketed as Criminal Case No. 25361.
The Court notes that on September 20, 2004, the Sandiganbayan rendered its decision in the mam case acquitting petitioner and Lambot on grounds of reasonable doubt and insufficiency of evidence.[3]
Considering that herein petitioner was already acquitted of the charges against him in Criminal Case No. 25361, there no longer exists any justiciable controversy that would need the invocation of this Court's judicial power.
WHEREFORE, the instant petition is hereby DISMISSED for being moot and academic.
SO ORDERED.
