RE: QUERY OF JOSE RICUERDO P. FLORES, CLERK OF COURT, RTC-OCC, MUNTINLUPA CITY ON THE PUBLICATION REQUIREMENTS IN CONNECTION WITH THE RECONSTITUTION OF RECORDS WHICH WERE GUTTED BY FIRE.

Quoted hereunder, for your information, is a resolution of the Court En Banc dated February 5, 2008
"A.M. No. 08-1-27-RTC.- Re: Query of Jose Ricuerdo P. Flores, Clerk of Court, RTC-OCC, Muntinlupa City on the Publication Requirements in Connection with the Reconstitution of Records Which Were Gutted by Fire.- The Court Resolved, upon the recommendation of the Office of the Court Administrator, to:
"A.M. No. 08-1-27-RTC.- Re: Query of Jose Ricuerdo P. Flores, Clerk of Court, RTC-OCC, Muntinlupa City on the Publication Requirements in Connection with the Reconstitution of Records Which Were Gutted by Fire.- The Court Resolved, upon the recommendation of the Office of the Court Administrator, to:
(a) NOTE the letter of Atty. Jose Ricuerdo P. Flores, Clerk of Court VI, RTC, Muntinlupa City, stating that they have a hard time complying with Act 3110 due to lack of funds; and
(b) GRANT Atty. Flores an EXEMPTION from the publication requirement under the abovementioned Act, as well as from the notice requirements for counsels and/or the parties, considering that there are no other records where to base their respective addresses.
(c) DIRECT Atty. Flores to POST the Notice regarding the fire and destruction of the records in RTC, Branch 276, Muntinlupa City, in three (3) conspicuous public places, such as the main entrances of Halls of Justice, Provincial Capitol, City or Municipal Hall, and the Post Office, for a period of at least thirty (30) days."
