G.R. No. 197823 (PEOPLE OF THE PHILIPPINES v. NELIA OGALESCO y TORIO). - Considering the allegations, issues and arguments presented in the appeal, the Court resolves to DENY the appeal for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in its assailed Decision dated February 7, 2011 as to warrant the exercise of the Court's appellate jurisdiction.chanroblesvirtuallawlibrary
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated February 7, 2011 of the CA in CA-G.R. CR-H.C. No. 03514 and AFFIRMS said Decision finding appellant Nelia Ogalesco y Torio guilty beyond reasonable doubt of the crime of Violation of Section 4(a) in relation to Section 6(a) and Section 10(c) of Republic Act No. 9208, otherwise known as the Anti-Trafficking in Persons Act of 2003, sentencing her to Life Imprisonment and imposing a fine of two million pesos (PhP 2,000,000). The modification of moral damages to twenty five thousand pesos (PhP 25,000) each and exemplary damages of twenty five thousand pesos (PhP 25,000) each is hereby affirmed.chanroblesvirtuallawlibrary
