AMELITA ABITONG V. PEOPLE OF THE PHILIPPINES
Sirs/Mesdames:
Please take notice that the Court, Second Division, issued a Resolution dated 21 February 2011 which reads as follows:
G.R. No. 176101 (AMELITA ABITONG v. PEOPLE OF THE PHILIPPINES). - Considering the allegations, issues and arguments presented in the Petition for Review, together with the Comment and the Reply, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated July 31, 2006, as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated July 31, 2006, of the Court of Appeals in CA-G.R. CR No. 29600 and AFFIRMS said Decision finding petitioner Araelita A. Abitong guilty beyond reasonable doubt of light threats penalized under the Revised Penal Code sentencing her to suffer the penalty of imprisonment of two (2) months and one (1) day of arresto mayor, medium, and to pay the costs.
SO ORDERED.
