PEOPLE OF THE PHILIPPINES V. WINNIEFREDO AMARO
G.R. No. 191369 (People of the Philippines v. Winniefredo Amaro). - The records of this case were elevated to this Court on March 30, 2010, pursuant to the Court of Appeals Resolution dated January 27, 2010 which gave due course to the notice of appeal filed by appellant Winniefredo Amaro.
In compliance with the Court's Resolution dated April 14, 2010, both the appellant and the Office of the Solicitor General filed their respective Manifestations stating that they are no longer filing their Supplemental Briefs with this Court; and that they are adopting all the allegations, issues and arguments adduced in their respective Briefs filed before the Court of Appeals.
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of the appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated November 26, 2009 of the Court of Appeals in CA-G.R. CR-H.C. No. 03212, finding appellant Winniefredo Amaro guilty beyond reasonable doubt of the crimes of Acts of Lasciviousness and Rape, sentencing him to suffer imprisonment of fourteen (14) years, eight (8) months, and one (1) day of reclusion temporal, as minimum, to seventeen (17) years, and four (4) months of reclusion temporal, as maximum, for the crime of Acts of Lasciviousness, and imprisonment of seventeen (17) years, four (4) months, and one (1) day of reclusion temporal, as minimum, to reclusion perpetua, as maximum, for the crime of Rape, with all the accessory penalties provided by law, and AFFIRMS said Decision.
