G.R. No. 195899 (Richard L. Uy v. People of the Philippines).
RESOLUTION
After review of the records, the Court resolves to DENY the petition for failure to show that the Court of Appeals (CA) committed reversible error when it upheld the RTC factual finding that the prosecution was able to discharge its burden of proving petitioner's direct participation in the commission of the robbery against the two complainants by allowing himself to use his own vehicle to facilitate the execution of robbery and to escape from the scene of the crime. Also, the CA is correct when it held that voluntary surrender does not mean innocence. Where, from the circumstances it can be inferred that the culprit gave himself up because he realized that the police officers' presence in the area precluded his escape, voluntary surrender cannot be appreciated in his favor. (People v. Arondain, 366 SCRA 98, 107 [2001]). In this case, the vehicle was registered in petitioner's name and there were many persons who saw him, and his vehicle's plate number at the scene of the crime. It would really not take long before authorities get to him.
Moreover, the petition failed to comply with the required certification against forum shopping under Section 4(e), Rule 45.
