G.R. No. 196943 (M1LAGROS M. FRANCISCO v. HON. HUMPHREY T. MONTEROSO, Deputy Ombudsman for Mindanao, MARIA CORAZON A. ARANCON, Director IV, et. al.)
RESOLUTION
The Court, after review of the records, resolves to DISMISS the petition for failure to sufficiently show that the Court of Appeals committed any grave abuse of discretion in rendering its Decision dated September 30, 2010 and its Resolution dated March 18, 2011, which appear to be in accord with the facts and applicable law and jurisprudence. As a rule, courts should not interfere with the Ombudsman's investigatory power, exercised through the Ombudsman Prosecutors, and the authority to determine the presence or absence of probable cause, except when the finding is tainted with grave abuse of discretion amounting to lack or excess of jurisdiction.[1]
SO ORDERED.
Very truly yours,
(Sgd.) LUCITA ABJELINA-SORIANO
Clerk of Court
