RE: LETTER OF FORMER PRESIDING JUSTICE DIOSDADO M. PERALTA OF THE SANDIGANBAYAN [NOW ASSOCIATE JUSTICE, SUPREME COURT], REQUESTING ADVICE AS TO THE PROPRIETY OF INHIBITIONS, INVOKED BY THE CHAIRPERSONS OF THAT COURT, RE: CIVIL CASE NO. 0141 [REPUBLIC OF THE PHILIPPINES V. FERDINAND MARCOS, ET AL.]
Sirs/Mesdames:
Please take notice that the Court en banc issued a Resolution dated JUNE 15, 2010, which reads as follows:
"A.M. No. 08-10-05-SB (Re: Letter of Former Presiding Justice Diosdado M. Peralta of the Sandiganbayan [now Associate Justice, Supreme Court], Requesting Advice as to the Propriety of Inhibitions, Invoked by the Chairpersons of that Court, re: Civil Case No. 0141 [Republic of the Philippines v. Ferdinand Marcos, et al.]). - On December 2, 2008, we issued a Resolution creating a Special Division, composed of Justice Norberto Y. Geraldez, as Chairman, and Justice Efren N. de la Cruz and Teresita V. Diaz-Baldos, as members, to try and decide Civil Case No. 0141, entitled "Republic of the Philippines v. Ferdinand Marcos, et al."
However, on April 4, 2010, Justice Norberto Y. Geraldez passed away. Hence, Justice Efren N. de la Cruz comes to us in his letter dated May 6, 2010, informing us that there are pending incidents in the case which need to be resolved. Accordingly, he requests the designation of an alternate member who shall sit in the Special Division in the event a member is absent. Specifically, he recommends Justice Alex L. Quiroz and Justice Maria Cristina J. Cornejo, as the regular and alternate members, respectively.
Acting on the letter of Justice Efren N. de la Cruz, the Court Resolved to RECONSTITUTE the Special Division to try and decide Civil CAse No. 0141, entitled "Republic of the Philippines v. Ferdinand Marcos, et al.," to Teresita V. Diaz-Baldos and Alex L. Quiroz, as regular members, and Justice Maria Cristina J. Cornejo as alternate members."
