G.R. No. 199036 (GILBERT PAWAAN y GARIDO v. PEOPLE OF THE PHILIPPINES) - Considering the allegations, issues and arguments presented in the petition for review, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated May 4, 2011 and Resolution dated October 12, 2011 as to warrant the exercise of the Court's appellate jurisdiction.chanroblesvirtuallawlibrary
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated May 4, 2011 and Resolution dated October 12, 2011 of the Court of Appeals in CA-G.R. CR-H.C. No. 04170 and AFFIRMS said Decision finding petitioner Gilbert Pawaan y Garido guilty beyond reasonable doubt of the crime of Murder, as defined and penalized under the Revised Penal Code, sentencing him to suffer the penalty of reclusion perpetua and to pay the heirs of the victim the amounts of P50,000.00 as civil indemnity and P124,700.00 as actual damages with MODIFICATION that petitioner is hereby ordered to pay the heirs of the victim the additional amounts of P50,000.00 as moral damages and P30,000.00 as exemplary damages in view of prevailing jurisprudence.
