RESOLUTION
After a review of the records, the Court resolves to DENY the petition for review on certiorari for failure of petitioner to show that the Court of Appeals (CA) erred in finding him guilty beyond reasonable doubt of the crime of homicide for the death of Erick John Rico y Balayon, Jr.chanroblesvirtuallawlibrary
The penalty of imprisonment imposed by the CA is, however, MODIFIED to six (6) years and one (1) day of prision mayor minimum as minimum, to twelve (12) years and one (1) day of reclusion temporal minimum as maximum. Appellant is further ordered to pay the victim's heirs P50,000.00 as civil indemnity, P50,000.00 as moral damages and P85,957.23 in actual damages. The award of P25,000.00 in temperate damages to answer for litigation expenses is DELETED for lack of legal basis.chanroblesvirtuallawlibrary
