DENNIS A.B. FUNA v. MANILA ECONOMIC AND CULTURAL OFFICE [MECO] AND COMMISSION ON AUDIT
Please take notice that the Court en banc issued a Resolution dated DECEMBER 6, 2011, which reads as follows:chanroblesvirtuallawlibrary
"G.R. No. 193462 (Dennis A.B. Funa vs. Manila Economic and Cultural Office [MECO] and Commission on Audit).- The Court Resolved to -
(a) NOTE the following pleadings and REQUIRE the Commission on Audit (COA) to COMMENT thereon within ten (10) days from notice hereof:
(i) Vehement Objection to Manifestation by COA Dated October 17, 2011 with Omnibus Motion to Require COA to Explain Why It is Flouting with the Honorable Supreme Court and to Explain Its Shifting, Wishy-Washy and Self-Contradicting Position and Motion to Declare COA as Having Waived Its Right to File Memorandum dated November 3, 2011 filed by counsel for petitioner; and
(ii) Manifestation and Motion dated November 14, 2011 filed by counsel for respondent MECO, praying, among other things, that COA be ordered to explain or justify its issuance of Office Order No. 2011-069 and the sudden change in its position that MECO is not a government-owned or -controlled corporation or a government instrumentality; andchanroblesvirtuallawlibrary
(b) GRANT the Motion dated November 24, 2011 filed by counsel for respondent MECO for a second extension of fifteen (15) days from November 25, 2011, or until December 10, 2011, within which to file a memorandum."chanroblesvirtuallawlibrary
