PEOPLE OF THE PHILIPPINES VS. DY CHIN HU, DEXTER TAN Y JOSE, YU GO BUN A.K.A. ANTHONYU DE LEON AND CHOI WEN NEN
G.R. No. 191367 (People of the Philippines vs. Dy Chin Hu, Dexter Tan y Jose, Yu Go Bun a.k.a. Anthonyu de Leon and Choi Wen Nen). - The records of this case were elevated to this Court on March 10, 2010, pursuant to the Court of Appeals Resolution dated February 16, 2010 which gave due course to the notice of appeal filed by accused-appellants Dy Chin Hu, Dexter Tan y Jose, Yu Go Bun a.k.a. Anthonyu de Leon and Choi Wen Nen.
In compliance with the Court's Resolution dated April 14, 2010, both the accused-appellants filed their Supplemental Brief on July 6, 2010 while the Office of the Solicitor General filed a manifestations on August 2, 2010 stating that it would no longer file a Supplemental Brief with this Court; and that it would adopt all the allegations, issues and arguments adduced in its briefs filed before the Court of Appeals (CA).
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of the appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusion of law in the Decision dated July 15, 2009 of the Court of Appeals in CA-G.R. CR-HC No. 03298, finding accused-appellants Dy Chin Hu, Dexter Tan y Jose, Yu Go Bun a.k.a. Anthonyu de Leon and Choi Wen Nen guilty beyond reasonable doubt of violation of Section 5, Article II of Republic Act No. 9365, and sentenced each of them to suffer the penalty of life imprisonment and a fine of Five Hundred Thousand Pesos (P500,000.00).
