FELICITAS BELLO V. PEOPLE OF THE PHILIPPINES
G.R. No. 178041 (FELICITAS BELLO v. PEOPLE OF THE PHILIPPINES).-
Considering the allegations, issues and arguments presented in the Petition for Review, together with the Comment and the Reply, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated September 23, 2005 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated September 23, 2005 of the Court of Appeals in CA-G.R. CR No. 28722 and AFFIRMS said Decision finding petitioner Felicitas Bello guilty beyond reasonable doubt of the crime of Homicide penalized under the Revised Penal Code sentencing her to suffer the indeterminate penalty of SIX (6) YEARS and ONE (1) DAY of prision mayor, as minimum, to TWELVE (12) YEARS and ONE (1) DAY of reclusion temporal, as maximum, and to pay the heirs of the victim the amounts of P50,000.00 as moral damages, and P141,446.10 as actual damages, with MODIFICATION that petitioner is hereby ordered to pay the additional amount of P50,000.00 as civil indemnity ex delicto, for the death of the victim in view of prevailing jurisprudence. No. 975 dated 21 March 2011.
