EDUARDO P. MAÑOSO V. PEOPLE OF THE PHILIPPINES
G.R. No. 172052 (EDUARDO P. MA�OSO v. PEOPLE OF THE PHILIPPINES).-
Considering the allegations, issues and arguments presented in the Petition for Review, together with the Comment and the Reply, the Court resolves to DENY the petition for review for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated December 1, 2005 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated December 1, 2005 of the Court of Appeals in CA-G.R. CR No. 27019 and AFFIRMS said Decision finding petitioner Eduardo P. Ma�oso guilty beyond reasonable doubt of Falsification of Public Document defined and penalized under the Revised Penal Code sentencing him to suffer the indeterminate penalty of four (4) months and one (1) day of arresto mayor, as minimum, with MODIFICATION that the penalty imposed as maximum should be three (3) years, six (6) months, and twenty-one (21) days of prision correccional. The fine of P5,000.00 is sustained. Nachura, J., no part; Carpio Morales, J., designated additional member per Raffle dated September 10, 2007. Mendoza, J., on leave; Brion, J., designated additional member per S.O. No. 975 dated 21 March 2011.
