A.M. No. 90-9-2238-RTC.- Re: Circuitization of the Municipality of San Jose, Tarlac.- Acting on (1) Resolution of the Municipal Council of San Jose, Tarlac, dated July 3, 1990, requesting: (a) the inclusion of the newly created Municipality of San Jose, Tarlac within the areas covered by the Municipal Circuit Trial Court of Sta. Ignacia-Malayantoc-San Clemente; (b) that the Judge of the aforesaid court should hold session at the Municipality of San Jose since it is the nearest and accessible place to service the needs of the said municipalities; and (c) Mrs. Loreta P. Gutierrez be designated as Acting Clerk of Court concurrently as Court Stenographer; and (2) 2nd Indorsement of former Judge Rafael B. Hidalgo, Regional Trial Court, Branch 68, Tarlac, Tarlac, recommending that the status quo be maintained since the aforesaid judge has neither statistics nor other reliable considerations upon which he could base his comment on the aforesaid resolution, and stating that the caseload of the Municipal Circuit Trial Court, Sta. Ignacia-San Clemente-Mayantoc has not yet been properly acted since no Presiding Judge has been appointed thereto, the Court Resolved to (a) CIRCUITIZE the newly created Municipality of San Jose, Tarlac with the Municipal Circuit Trial Court, Sta. Ignacia-Mayantoc-San Clemente, Tarlac; and (b) MAINTAIN the status quo insofar as the situs where the judge should hold court is involved until actual study of relevant information and date is made. However, the appointment of Ms. Loreta P. Gutierrez as Acting Clerk of Court, shall be left to the sound discretion of the judge who may be appointed thereat. Feliciano, J., is on leave.
