RE: DESIGNATION OF ADDITIONAL FAMILY COURT IN THE RTC OF MALABON CITY.
Sirs/Mesdames:
Quoted hereunder, for your information, is a resolution of the Court En Banc dated October 7, 2008
"A.M. No. 08-9-538-RTC.- Re: Designation of Additional Family Court in the RTC of Malabon City.- The Court Resolved, upon the recommendation of the Office of the Court Administrator, to DESIGNATE the Regional Trial Court, Branch 73, Malabon City, as Family Court pursuant to the En Banc resolution dated March 1, 2000 in A.M. No. 99-11-07-SC (Designation of Certain Branches of the Regional Trial Courts as Family Courts).
The Following guidelines shall be observed:
"A.M. No. 08-9-538-RTC.- Re: Designation of Additional Family Court in the RTC of Malabon City.- The Court Resolved, upon the recommendation of the Office of the Court Administrator, to DESIGNATE the Regional Trial Court, Branch 73, Malabon City, as Family Court pursuant to the En Banc resolution dated March 1, 2000 in A.M. No. 99-11-07-SC (Designation of Certain Branches of the Regional Trial Courts as Family Courts).
The Following guidelines shall be observed:
(i) the regular cases already pending in Branch 73, Malabon City shall not be unloaded except those cases where trial has not yet begun (where the accused are not yet arraigned in criminal cases and where pre-trial has not yet commenced in civil cases);
(ii) newly filed family cases equal to the number of cases unloaded by RTC, Branch 73, Malabon City, shall be assigned to it and thereafter family cases shall be raffled between Branches 73 and 163 in the ratio of 3:1 until such time that the number of family cases assigned to Branch 73 is equal to the number of family cases assigned to Branch 169; and
(iii) the Executive Judge Shall see to it that equitable distribution of cases is affected."
