VENANCIO ALBOVIAS VS. JUDGE AMY MELBA S. BELULIA, REGIONAL TRIAL COURT, BRANCH 30, SAN PABLO CITY
Sirs/Mesdames:
Please take notice that the Court, Second Division, issued a Resolution dated 15 December 2010 which reads as follows:
A.M. OCA IPI No. 10-3488-RTJ (Venancio Albovias vs. Judge Amy Melba S. Belulia, Regional Trial Court, Branch 30, San Pablo City).�Before the Court is an administrative complaint against Judge Amy Melba S. Belulia (respondent Judge), Regional Trial Court, Branch 30, San Pablo City, for gross ignorance of the law relative to Bar Matter Nos. 850 and 1922.
The Court NOTES the Verified Complaint dated August 10, 2010 filed by Venancio Albovias stating that the latter is the defendant in Civil Case No. SP-6698 represented by Atty. Conrado L. Manicad; that in a letter dated April 13, 2010, Dir. IV Rustico T. De Belen, Mandatory Continuing Legal Education (MCLE), contended that Atty. Manicad cannot use his MCLE exemption on the ground of physical disability to engage in the practice of law, except for notarial service; and on the basis thereof, respondent Judge issued the disputed Order dated June 25, 2010 directing the expunction of the complainant's answer filed by his counsel.
The Court RESOLVES to ADOPT and APPROVE the findings of fact, conclusions of law and recommendation of the Office of the Court Administrator. Accordingly, the Court RESOLVES to DISMISS the complaint for lack of merit, the same being judicial in nature.
SO ORDERED.
