Please take notice that the Court, Third Division, issued a Resolution dated 19 October 2011, which reads as follows:
G.R. No. 197936 (Albert M.G. Garcia v. Office of the Director General-Intellectual Property Office).
RESOLUTION
The Court hereby resolves to DENY the petition, there being no reversible error on the part of the Court of Appeals (CA) in denying the petition before it. The CA correctly held that the mark "Gargol Mouth Flush and Device" sought to be registered by petitioner Garcia was descriptive of the product itself, and therefore not registrable under Section 123.1 (j) of the Intellectual Property Code.
