"A.M. No. 07-3-71-MCTC.- Re: Query of Clerk of Court Purita C. Visitacion, MCTC-Luna, Apayao on the Prohibition Against the Appointment of Court Employees as Brgy. Electoral Inspector and Member of the Municipal Board of Canvasser.- Acting on the Letter dated January 19, 2007 of Purita C. Visitacion, Clerk of Court, Municipal Circuit Trial Court, Luna-Pudtol-Calanasan, Luna, Apayao, the Court Resolved, upon the recommendation of the Office of the Court Administrator, to
"A.M. No. 07-3-71-MCTC.- Re: Query of Clerk of Court Purita C. Visitacion, MCTC-Luna, Apayao on the Prohibition Against the Appointment of Court Employees as Brgy. Electoral Inspector and Member of the Municipal Board of Canvasser.- Acting on the Letter dated January 19, 2007 of Purita C. Visitacion, Clerk of Court, Municipal Circuit Trial Court, Luna-Pudtol-Calanasan, Luna, Apayao, the Court Resolved, upon the recommendation of the Office of the Court Administrator, to
(a) NOTE the aforesaid letter of Purita C. Visitacion relative to her query on authority/prohibition against appointment of court employees as Barangay Electoral Inspector and member of Municipal Board of Canvasser;
(b) ADVISE Ms. Visitacion of the following applicable rules, issuances and jurisprudence relative to her query: (i) Section 5[a], Canon III of the Code of Conduct for Court Personnel providing that outside employment should not be with a person or entity that conducts business with the Judiciary; (b) in line with the preservation of public faith and confidence in the judiciary, Section 5 (last paragraph) of the same Code providing that court personnel shall not accept the outside employment where the same would reflect adversely on the integrity of the Judiciary; (c) Administrative Circular No. 5 dated October 4, 1998 which provides that "the entire time of Judiciary officials and employees must be devoted to government service to insure efficient and speedy administration of justice"; and (d) Lloveras v. Sanchez (Administrative Matter P-93-817, January 18, 1994) and other related jurisprudence on the matter." Puno, C.J., and Quisumbing, J., on official leave.
