RE: REPORT ON THE JUDICIAL AUDIT CONDUCTED AT THE REGIONAL TRIAL COURT, BRANCH 9, MANILA

Quoted hereunder, for your information, is a resolution of the Court En Banc dated September 25, 2007
"A.M. No. 07-9-464-RTC.- Re: Report on the Judicial Audit Conducted at the Regional Trial Court, Branch 9, Manila,- The Court Resolved, upon the recommendation of the Office of the Court Administrator in its Memorandum dated August 31, 2007, to
"A.M. No. 07-9-464-RTC.- Re: Report on the Judicial Audit Conducted at the Regional Trial Court, Branch 9, Manila,- The Court Resolved, upon the recommendation of the Office of the Court Administrator in its Memorandum dated August 31, 2007, to
I. NOTE the aforesaid Memorandum Report dated August 31, 2007 of the Audit Team that conducted a judicial audit of RTC, Branch 9, Manila;
ll-a. DIRECT Judge Amelia T. Infante, Presiding Judge, Regional Trial Court (Branch 9), Manila, to EXPLAIN within fifteen (15) days from receipt of notice, why she should not be dealt with administratively for the following:1. failure to decide within the reglementary period the 15 criminal cases and the 6 civil cases. mentioned in this Memorandum;ll-b. Likewise DIRECT Judge Infante to:
2. failure to resolve within the reglementary period the pending incidents in 5 criminal cases and 7 civil cases mentioned in this Memorandum;
3. failure to act on 39 criminal and 56 civil cases mentioned in this Memorandum that had been without action/setting for a considerable length of time; and
4. resetting hearings in 18 criminal and 7 civil cases for reasons based on "personal commitment" and on the need to "pen important injunction cases."1. decide, within 60 days from receipt of notice, the 15 criminal and 6 civil cases that had long been submitted for decision and to submit copies of each of the decision to the Court Management Office within 10 days from their promulgation;III. DIRECT Atty. Emmanuel P. Villanueva, Branch Clerk of Court, RTC Branch 9, Manila, to EXPLAIN within fifteen (15) days from receipt of notice why he should not be administratively dealt with for the following infractions:
2. resolve, within 60 days from receipt of notice, the 5 criminal and 7 civil cases with pending incidents/motions that had long been submitted for decision and to submit copies of each of the resolution to the Court Management Office within 10 days from their promulgation; and
3. immediately take appropriate action on the 94 cases (39 criminal, 55 civil cases) mentioned in this Memorandum that had been without action/setting for a considerable length of time.1-a. failure to faithfully update Judge Infante of the 15 criminal and 6 civil cases that are long overdue for decision;
1-b. failure to faithfully update Judge Infante of the pending incidents in 5 criminal and 7 civil cases that are long overdue for resolution;
2. failure to faithfully reflect in the court's Docket Inventory for the period July-December 2006 the status of the 15 criminal and 6 civil cases submitted for decision, particularly the orders submitting the said cases for decision;
3. failure to apprise Judge Infante of the 39 criminal and 55 civil cases mentioned in this Memorandum that had been without action/setting for a considerable length of time;
4-a. failure to have the orders for issuance of warrant of arrest signed by Judge Infante in 21 criminal cases mentioned in this Memorandum;
4-b. failure to deliver within a reasonable time the warrants of arrest in 32 criminal cases to the Sheriff's Office;
5. failure to reduce into orders the directives of Judge Infante in 6 criminal and 12 civil cases mentioned in this Memorandum;
6. failure to transmit for re-raffle within a reasonable time 4 criminal cases; and
7. failure to implement an efficient system vis-a-vis the safekeeping of court records and documents."
