Quoted hereunder, for your information, is a resolution of the Court En Banc dated September 11,2007

"A.M. No. 07-8-401-RTC- Re: Creation of Additional RTC in the Province of Lanao del Sur to be Stationed at the Municipality of Wao.- The Court Resolved to NOTE the Memorandum dated August 8, 2007 of the Office of the Court Administrator (OCA) relative to Republic Act No. 9423, otherwise known as "An Act Creating An Additional Branch of the Regional Trial Court in the Province of Lanao del Sur to be stationed at the Municipality of Wao Amending for the Purpose Section 14, Paragraph (m) of Batas Pambansa Big. 129, Otherwise Known as the Judiciary Reorganization Act of 1980, as Amended, and Appropriating Funds Therefor."

The Court further Resolved, upon the recommendation of the OCA, to

1. IMPLEMENT Republic Act No. 9423, otherwise known as an "An Act Creating An Additional Branch of the Regional Trial Court in the Province of Lanao del Sur to be stationed at the Municipality of Wao Amending for the Purpose Section 14, Paragraph (m) of Batas Pambansa Big. 129, Otherwise Known as the Judiciary Reorganization Act of 1980, as Amended, and Appropriating Funds Therefor" and CREATE additional RTC branch in the Province of Lanao del Sur to be denominated as RTC, Branch 26 stationed at Wao, Lanao del Sur;

2. CREATE the following positions and INCLUDE them in the Personnel Services Itemization of the Regional Trial Court, Branch 26, Wao, Lanao del Sur to conform with the Staffing Pattern of the Regional Trial Court, to wit:

3. DIRECT the Office of Administrative Serviced, OCA to SUBMIT to the Department of Budget and Management (DBM) the newly created positions to be included in the Personnel Services Itemization of the RTC for inclusion in the General Appropriations Act for funding purposes;

4. Thereafter, DIRECT the Financial Management Office, OCA, to SUBMIT to DBM the funding requirements for the full implementation of RA 9423;

5. DIRECT the DBM to RELEASE the Supplemental Allotment Release Order (SARO) and the corresponding Notice of Cash Allocation (NCA) for the full implementation of R.A. 9423;

6. HOLD IN ABEYANCE The organization of the RTC, Branch 26, Wao, Lanao de! Sur, until such time that the DBM has released the aforesaid SARO and NCA; and

7. AMEND Administrative Order No. 7 dated February 11, 1983 under the paragraph Province of Lanao del Sur, to read as follows:

LANAO DEL SUR

Branches 8 to 10, inclusive, with seats at Marawi City - comprising Marawi City and the municipalities of Bacolod Grande, Balindong, Buadiposo-Buntong, Bubong, Ditsaan-Ramain, Ganassi, Kapai, Lumba-Bayabao, Madalum, Madamba, Maguing, Marantao, Masiu, Mulondo, Piagapo, Poona-Bayabao, Pualas, Saguiaran, Tagoloan II, Tamparan, Taraka and Tugawa.

Branches 11 to 12, inclusive with seats at Malabang - comprising the municipalities of Balabagan, Bayang, Binidiyan, Butig, Calanogas, Kapatagan, Lumbatan, Lumbayanague, Malabang, Marogong, Pagayawan, Sultan Gumander and Tubaran.

Branch 26 with seat at Wao - comprising the municipalities of Bumbaran and Wao.

8. OBSERVE the following pending the organization of the Regional Trial Court, Branch 26, Wao:

a. Cases falling within the jurisdiction of the Regional Trial Court originating from the municipalities of Bumbaran and Wao shall continue to be heard in the Regional Trial Court of Marawi City until disposition;

b. Once a presiding judge has been appointed to Branch 26 together with his staff and has assumed judicial functions, cases falling within the jurisdiction of the RTC originating from the aforesaid municipalities shall be filed with Branch 26 provided that:

b1. The RTC of Marawi City shall continue trying the pending cases under the jurisdiction of Branch 26 already heard by the former unless the parties agree that the cases be transferred to Branch 26; and

b2. Cases already filed in the RTC of Marawi City but have not yet reached the pre-trial stage in case of civil cases and the accused not yet arraigned in case of criminal cases which are cognizable by Branch 26, shall be unloaded to Branch 26.

9. AMEND all records accordingly to conform with this development."
