PEOPLE OF THE PHILIPPINES V. EDGARDO DE GUZMAN Y RIVERA
G.R. No. 190618 (People of the Philippines v. Edgardo de Guzman y Rivera). - The records of this case were elevated to this Court on January 6, 2010, pursuant to the Court of Appeals Resolution dated October 27, 2008 which gave due course to the notice of appeal filed by appellant Edgardo de Guzman.
In compliance with the Court's Resolution dated April 28, 2010, the accused-appellant filed a Supplemental Brief and the Office of the Solicitor General filed its Manifestation and Motion stating that it is no longer filing a Supplemental Brief with this Court and that it is adopting all the allegations, issues and arguments adduced in its Brief filed before the Court of Appeals.
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the court ADOPTS the findings of fact and conclusions of law in the Decision dated September 28, 2009 of the Court of Appeals in CA-G.R. CR.-H.C. No. 03180, finding appellant Edgardo de Guzman y Rivera guilty beyond reasonable doubt for violation of Sections 5 and 11, Article II of Republic Act No. 9165, and AFFIRMS said Decision.
