PEOPLE OF THE PHILIPPINES V. FERNANDO SALAS Y AGRIAM
Sirs/Mesdames:
Please take notice that the Court, Second Division, issued a Resolution dated 09 February 2011 which reads as follows:
G.R. No. 182235 (PEOPLE OF THE PHILIPPINES v. FERNANDO SALAS y AGRIAM). - Considering the allegations, issues and arguments presented in the appeal, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated August 7, 2007, as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated August 7, 2007 of the Court of Appeals in CA-G.R. CR-H.C. No. 02520 and AFFIRMS said Decision finding appellant Fernando Salas y Agriam guilty beyond reasonable doubt of illegal sale of dangerous drugs in violation of Section 5, Art. II of RA 9165, otherwise known as The Comprehensive Dangerous Drugs Act of '2002, sentencing him to suffer the penalty of life imprisonment and to pay a fine of Five Hundred Thousand Pesos (P500,000.00). (Nachura, J., no part; Villarama, Jr., J. designated additional member, per raffle dated February 9, 2011.)
SO ORDERED.
G.R. No. 182235 (PEOPLE OF THE PHILIPPINES v. II of RA 9165, otherwise known as The Comprehensive Dangerous Drugs Act of '2002, sentencing him to suffer the penalty of life imprisonment and to pay a fine of Five Hundred Thousand Pesos (P500,000.00). (Nachura, J., no part; Villarama, Jr., J. designated additional member, per raffle dated February 9, 2011.)
