Please take notice of that the Court en banc issued a Resolution dated JANUARY 11, 2011, which reads as follows:

"G. R. No. 176389 (Antonio Lejano vs. People of the Philippines) and G.R. No. 176864 (People of the Philippines vs. Hubert Jeffrey P. Webb, et al.).- The Court Resolved to

(a) NOTE the Manifestation dated December 14, 2010, filed by counsel for appellant Hubert Jeffrey P. Webb, stating that on December 2, 2010, they filed this Court  a  Petition Cite Officers of the NBI in Contempt docketed as G.R. No. 194469;

(b) NOTE the Leter dated December 14, 2010 of Recarredo S. Valenzuela, Clerk Court IV, MTC, Personnel Division, OAS-OCA, and DENY his request that he be furnished with a copy of the latest Motion for Reconsideration of Hubert Webb in People of the Philippines vs. Hubert Webb, considering that he is not a party to the case;

(c)  NOTE the Letter dated December 28, 2010 of Atty. Magtanggol B. Gatdula, Director, National Bureau of Investigation (NBI), and GRANT his request that the NBI be furnished with a photocopy of the entire records of this case, in accordance with the order of the President for a thorough reinvestigation of the Vizconde Massacre;

(d) INFORM NBI Director Gatdula that he may send his authorized representative to have the entire records of the case photocopied;

(e)  NOTE the Letter dated December 15, 2010 of PSIV Armando T. Miranda, Chief Superintended, Bureau of Corrections, informing the Court that in compliance with Notice of Judgment, Decision and Order of Release dated December 14, 2010 rendered by the Court the following inmates were released from the custody of the Bureau of Corrections on December 14, 2010, having been Acquitted in Criminal Case No. 95-404 for Rape with Homicide G.R. Nos. 176389 and 176864, to wit:

1.  Hubert Jeffrey R. Webb y Pagaspas
2. Antonio "Tony Boy" Lejano y de Leon
3. Miguel "Ging" Rodriguez y Andres
4. Michael Gatchalian y Adviento
5. Hospicio "Pyke" Fernandez y Aldecoa
6. Peter Estrada y Mascardo;

(f)  NOTE the Omnibus Motion: (1) To Strike Out Motion for Reconsideration Filed by the public Attorney's Office; and (2) To Issue Show-Cause Order, dated January 6, 2011, filed by counsel for Hubert Jeffrey P. Webb; and

(g)  NOTE  the Letter dated January 6, 2011 of Atty. Bonifacio A. Alentajan, Alentajan Law Office, 24 Ilongot Street, La Vista, Quezon City, Philippines, complaining against Public Attorney's Office Chief Persida V. Rueda-Acosta for violating the Canons of Legal Ethics for abusing her official time in giving unwarranted benefit to a private person, and also mentioning the interference of Fr. Robert Reyes, activist nun Mary John Mananzan, Bishop Melchor Evangelio Mercado and anti-crime crusader Dante Jimenez who file their own motion for intervention.

The Court further Resolved to DENY the prayer to set the case for Oral Argument on January 25, 2011 at 2 p.m., dated December 28, 2010 filed by the Public Attorney's Office for private complainant Lauro G. Vizconde." The Members maintained their votes.

Carpio, Velasco, Jr., Nachura, and del Castillo, JJ., no part.
