FREDDIE URBANO AND SALVADOR URBANO V. PEOPLE OF THE PHILIPPINES
G.R. No. 182288 (FREDDIE URBANO and SALVADOR URBANO v. PEOPLE OF THE PHILIPPINES). � Considering the allegations, issues and arguments presented in the Petition for Review, together with the Comment and the Reply, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated November 7, 2007 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated November 7, 2007 of the Court of Appeals in CA-G.R. CR No. 30312 and AFFIRMS said Decision finding petitioners Freddie Urbano and Salvador Urbano guilty beyond reasonable doubt of illegal possession of marijuana, a dangerous drug, in violation of Section II, Article II of Republic Act No. 9165, otherwise known as the "Comprehensive Dangerous Drugs Act of 2002" sentencing them to suffer the penalty of imprisonment of twelve (12) years and one (1) day, as minimum, to twenty (20) years, as maximum, and to pay a fine of Three Hundred Thousand Pesos (P300,000.00). (Perlas-Bernabe, J., no part due to prior concurrence in the assailed Court of Appeals Decision and Resolution; Perez, J., designated additional member per Raffle dated October 3, 2011).
