RE: DESIGNATION OF JUDGE FROM ANOTHER JURISDICTION TO HEAR AND DECIDE CIVIL CASE NO. 6088 PENDING AT RTC, BRANCH 6, DIPOLOG CITY.

Quoted hereunder, for your information, is a resolution of the Court En Banc dated April 29, 2008
"A.M. No. 08-4-212-RTC. - Re: Designation of Judge from Another Jurisdiction to Hear and Decide Civil Case No. 6088 Pending at RTC, Branch 6, Dipolog City. - The Court Resolved, upon the recommendation of the Office of the Court of Administrator, to

"A.M. No. 08-4-212-RTC. - Re: Designation of Judge from Another Jurisdiction to Hear and Decide Civil Case No. 6088 Pending at RTC, Branch 6, Dipolog City. - The Court Resolved, upon the recommendation of the Office of the Court of Administrator, to
(a) NOTE the petition dated December 28, 2007 of plaintiff Gardito C. Ajero requesting for the designation of a judge to hear Civil Case No. 6088. and the Order dated October 2007 of Judge Hipolito P. Bael, Jr., Presiding Judge, Regional Trial Court(RTC), Branch 6, Dipolog City;Martinez, J., on official leave.
(b) RELIEVE Judge Bael, Jr., of his authority to hear and decide the aforesaid civil case; and DESIGNATE Judge Ma. Nimda P. Sitaca, Presiding Judge, RTC, Branch 13, Oroquieta City, to hear and decide the same in RTC, Branch 6, Dipolog City, using the personnel of teh latter court;
(c) AUTHORIZE Judge Sitaca to receive per diems and reimbursement of actual traveling expenses whenever she goes to Dipolog City to hear and decide the case; and
(d) DIRECT Judge Sitaca to furnish the Court, through the Office of the Court Administrator, with a copy of the decision within ten (10) days from rendition thereof."
