Quoted hereunder, for your information, is a resolution of the Court En Banc dated April 15, 2008
"G.R. No. 173397 (Liberato Z. Villegas v. Commission on Elections and Gerald Z. Gabutan), - Filed on July 27, 2006 is a petition for certiorari asailing respondent COMELEC's Resolution dated July 6, 2006 denying petitioner's motion for reconsideration of the earlier Resolution dated July 5, 2005, which granted the pettition for certiorari filed by private respondent on the order of the Regional Trial Court, Branch 44, Dagupan City dismissing the elction protested by private respondent.
Petitioner and private respondens are two among the three cnadidates for vice-mayor in San Fabian, Pangasinan last May 11, 2004 elections. This case has already become moot in view of the expiration of the term of office of the contested vice-mayoralty position on June 30, 2007.
WHEREFORE, the petition is hereby DISMISSED for being moot.
