RE: REQUEST FOR AN ADDITIONAL FAMILY COURTS IN PUERTO PRINCESA.

Quoted hereunder, for your information, is a resolution of the Court En Banc dated April 29, 2008
"A.M. No. 08-4-232-RTC.- Re: Request for an Additional Family Courts in Puerto Princesa.- The Court Resolved, upon the recommendation of the Office of the Court Administrator, to
"A.M. No. 08-4-232-RTC.- Re: Request for an Additional Family Courts in Puerto Princesa.- The Court Resolved, upon the recommendation of the Office of the Court Administrator, to
(a) GRANT the request of Executive Judge Pe, the Presiding Judges of all the Regional Trial Court (RTC) branches in Puerto Pricesa City, and the Presiding Judge of RTC Roxas City for the designation of an additional family court in the Regional Trial Court of Puerto Princesa City;
(b) DESIGNATE the RTC, Branch 47, Puerto Princesa City as additional family court in the RTC of Puerto Princesa City; and
(c) OBSERVE the following guidelines in the unloading of cases:(i) The RTC, Branch 47 shall continue hearing and deciding cases pending in the said sala where trial has already begun. For this purpose, trial has begun when the accused or any of the accused in a criminal case has been arraigned or when the pre-trial stage is terminated in civil cases;
(ii) All cases pending in RTC, Branch 47 where trial has not yet begun, shall be transmitted to the Office of the Clerk of Court for raffle among the regular courts;
(iii) All newly-filed family court cases shall be assigned to RTC, Branch 47 until such time when the number of cases assigned is equivalent to the cases it has transmitted to the Office of the Clerk of Court. Subsequently, all newly-filed family court cases shall be raffled to Branches 47 and 50 on a 2:1 ratio as follows: two (2) newly-filed cases to RTC, Branch 47 and one (1) newly-filed case to be raffled to the RTC, Branch 50 until such time that the family court cases assigned to RTC, Branch 47 are equal to the family court cases assigned to RTC, Branch 50. The assignment of newly-filed cases to RTC, Branch 50 is an exception to Section 5, Chapter V of the Guidelines on the Selection and Designation of Executive Judges and Defining their Powers, Prerogatives and Duties (A.M. No. 03-8-02-SC) which provides for the exclusion from the raffle a vacant branch without a regular judge;
(iv) The Executive Judge shall see to it that equitable distribution of cases is effected; and
(v) The guidelines set forth in the resolution dated February 1, 2000 in A.M. No. 99-11-07-SC (Re: Designation of Certain Branches of the Regional Trial Courts as Family Courts), shall be observed insofar as applicable." Austria-Martinez, J., on official leave. Corona, J., on leave.
