JAIME S. DOMDOM VS. HON. THIRD DIVISION OF THE SANDIGANBAYAN, COMMISSION ON AUDIT AND THE PEOPLE OF THE PHILIPPINES
"G.R. Nos. 197372-78 (Jaime S. Domdom vs. Hon. Third Division of The Sandiganbayan, Commission on Audit and the People of the Philippines).- In accordance with Rule 65 and other related provisions of the 1997 Rules of Civil Procedure, as amended, governing petitions for certiorari, prohibition and mandamus filed with the Supreme Court, only petitions which are accompanied by or which comply strictly with the requirements specified therein shall be entertained. On the basis thereof, the Court Resolved to DISMISS the instant petition for certiorari for non-compliance therewith, particularly for
(a) late filing as the petition was filed on August 31, 2011, the due date being August 21, 2011; and
(b) failure to pay the deposit for sheriffs fees in violation of Section 3, Rule 46 in relation to Section 2, Rule 56.
In any event, the petition would still be dismissed for failure to sufficiently show that any grave abuse of discretion was committed by the Third Division of the Sandiganbayan in rendering the challenged resolutions which, on the contrary, appear to be in accord with the facts and applicable law and jurisprudence.�
