RESOLUTION
Please take notice that the Court, Third Division, issued a Resolution dated 21 September 2011, which reads as follows:cralaw
After review of the records, the Court resolves to DENY the petition for failure to show that the Court of Appeals (CA) committed reversible error in its Decision dated December 17, 2010 and Resolution dated June 27, 2011 in CA-G.R. SP 113225, which affirmed in toto the National Labor Relations Commission and the Labor Arbiter's Decision. Petitioner raised the issue of validity of respondent Renato V. Supan's dismissal, which is factual in nature and is not a proper subject of a petition for review under Rule 45 of the Rules of Court. With the unanimous decision of the labor tribunal and the CA and following the doctrine that findings of fact of the CA are conclusive on the Court, this Court will not disturb or review such findings. Lastly, the Court found that the petition was belatedly filed for a month, a violation of Section 2, Rule 45 of the Rules of Court.cralaw
