REQUEST FOR CLARIFICATION ON THE EXEMPTION OF THE COMELEC FROM PAYMENT OF ALL LEGAL FEES
"A.M. No. 11-4-02-O (Request for Clarification on the Exemption of the COMELEC from Payment of all Legal Fees).- The Court Resolved, upon the recommendation of the Office of the Court Administrator, to
(a) NOTE the Letter dated January 24, 2011 of Atty. Ferdinand T. Rafanan, Director IV, CEO VI, CESO III, Law Department, Commission on Elections (COMELEC); and
(b) EXEMPT the COMELEC from the payment of all legal fees, not only in Petitions for Inclusions, Exclusions or Correction of Names of Voters, but in all other petitions it may initiate, provided that the same was brought in the name of or on behalf of the COMELEC. However, the COMELEC is not exempt from the deposit/payment of sheriffs expenses under Section 10, Rule 141 of the Revised Rules of Court in all petitions it may initiate." Nachura, J., on leave.
