PEOPLE OF THE PHILIPPINES VS. SAMMY LASDON Y GAMPONG
G.R. No. 194834 (People of the Philippines vs. Sammy Lasdon y Gampong). - The records of this case were elevated to this Court on January 11, 2011, pursuant to the Court of Appeals Resolution dated October 11, 2010 which gave due course to the notice of appeal filed by accused-appellant Sammy Lasdon y Gampong.
In compliance with the Court's Resolution dated January 26, 2011, both the accused-appellant and the Office of the Solicitor General filed their respective Manifestations and waiver stating that they are no longer filing their Supplemental Briefs with this Court; and that they are adopting all the allegations, issues and arguments adduced in their respective briefs filed before the Court of Appeals.
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of the appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusion of law in the Decision dated September 9, 2010 of the Court of Appeals in CA-G.R. CR-H.C No. 03828, finding accused-appellant Sammy Lasdon y Gampong guilty beyond reasonable doubt of violation of Sections 5 and 11, Article II of Republic Act No. 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002 and to suffer the penalty of: (1) in Criminal Case No. 14315-D, life imprisonment and to pay a fine of Five Hundred Thousand Pesos (P500,000.00); and (2) in Criminal Case No. 14316-D, imprisonment of twelve (12) years and one (1) day to twenty (20) years and to pay a fine of Three Hundred Thousand Pesos (P300,000.00).
