PEOPLE OF THE PHILIPPINES V. ROGELIO BAYNA Y ABRIQUE
G.R. No. 194607 (People of the Philippines v. Rogelio Bayna y Abrique). - The records of this case were elevated to this Court on December 15, 2010, pursuant to the Court of Appeals Resolution dated June 29, 2010 which gave due course to the notice of appeal filed by appellant Rogelio Bayna y Abrique.
In compliance with the Court's Resolution dated January 12, 2011, the Office of the Solicitor General filed a Supplemental Brief and the accused-appellant filed a Manifestation and Motion stating that he is no longer filing a Supplemental Brief with this Court and is adopting all the allegations, issues, and arguments adduced in his Brief filed before the Court of Appeals.
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of the appellant to sufficiently show any reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated April 23, 2010 of the Court of Appeals in CA-G.R. CR-H.C. No. 03471, finding appellant Rogelio Bayna y Abrique guilty beyond reasonable doubt of the crime of two counts of rape, and sentencing him to suffer imprisonment of reclusion perpetua for each case and to indemnify the offended party the sum of seventy-five thousand pesos (P75,000.00) as civil indemnity, fifty thousand pesos (P50,000.00) by way of moral damages for each case, and twenty-five thousand pesos (P25,000.00) as exemplary damages, and AFFIRMS said Decision in toto.
