Belmonte, Jr., House of Representatives, Senate President Juan Ponce Enrile, Senate, Pasay City, Hon. Paquito Ochoa, Jr., Executive Secretary, Malaca�ang, Hon. Florencio Abad, Jr., Budget Secretary, Malaca�ang, Hon. Roberto Tan, National Treasurer, Manila).- In accordance with Rule 64 and other related provisions of the 1997 Rules of Civil Procedure, as amended, governing review of judgments and final orders or resolutions of the Commission on Elections, only petitions which are accompanied by or which comply strictly with the requirements specified therein shall be entertained. On the basis thereof, the Court Resolved to DISMISS the instant petition for certiorari for non-compliance therewith, particularly for insufficiency of the petition in form due to improper verification and lack of notarization. In any event, it is premature to question the constitutionality of a pending bill in Congress (Montesclaros v. COMELEC, 433 Phil. 620 [2002]).
The Court further Resolved to DENY the Motion for Consolidation dated May 3, 2011 filed by the Office of the Solicitor General in view of the above dismissal of the petition." Nachura, J., on leave. Del Castillo, J., on official leave.
