A.C. No. 8002 (Juanito A. Conol, Jr., et al. v. Atty. Rafael N. Cristobal).
RESOLUTION
Considering the Manifestation/Motion dated August 15, 2011 filed by Juanito A. Conol, Jr., the Court resolves to TREAT it as a petition for review of Resolution X1X-2010-517 dated September 18, 2010 and Resolution XIX-2011-314 dated June 26, 2011, both issued by the IBP Board of Governors, and DENY the same for lack of merit. The IBP Board of Governors did not commit any reversible error in finding that there is no sufficient basis to hold Atty. Rafael N. Cristobal administratively liable and in ordering the dismissal of the case against him. The legality and validity of TCT N-221818 has not been assailed in any court proceeding, hence, its validity and due execution still stand. Since the alleged falsity of the title has not been proven, there is no basis to hold or even accuse Atty. Cristobal of participation in or even knowledge of the alleged falsification.
