GMA NETWORK, INC. v. NATIONAL TELECOMMUNICATIONS COMMISSION
G.R. No. 195980 (GMA Network, Inc. v. National Telecommunications Commission) - The Court DENIES the Motion for Reconsideration dated 03 August 2011 filed by petitioner GMA Network, Inc., (GMA), since no substantial arguments are offered that have not already been raised in the instant Petition and deliberated upon by the Court.
Petitioner GMA has failed to establish that the Court of Appeals' Decision dated 04 March 2011 was not in accord with law or applicable jurisprudence. Well-taken, in fact, was the appellate court's reliance on the case of Sambrano v. Public Service Commission (G. R. No. L-18459, 29 September 1962, 6 SCRA 245), which found that the 60-day prescriptive period under the Public Service Act (CA No. 146, Sec. 28) was applicable only to criminal or penal proceedings.
The Court's exercise of its discretionary appellate jurisdiction in resolving the instant Petition is limited only to a review of the said Decision of the court a quo. Petitioner GMA's other pending Petitions before the Court involve the different operations of its other television and radio stations, separate administrative and judicial proceedings, and distinct decisions of the Court of Appeals. That this Court has found no reversible error in the questioned Decision of the Court of Appeals in the instant Petition will not preempt the Court's discretionary review of the other pending Petitions, if petitioner GMA can satisfactorily demonstrate good reasons for the grant thereof.cralaw
