PEOPLE OF THE PHILIPPINES v. MARLON CHUA AND EDWIN CARO
G.R. No. 194444 (PEOPLE OF THE PHILIPPINES v. MARLON CHUA and EDWIN CARO). - Considering the allegations, issues and arguments presented in the appeal, the Court resolves to DENY the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated May 20, 2010 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated May 20, 2010 of the Court of Appeals (CA) in CA-G.R. CR-H.C. No. 03327 and AFFIRMS said Decision finding appellants Marlon Chua and Edwin Caro guilty beyond reasonable doubt of: (1) the crime of selling dangerous drugs in violation of Section 5, Article II of Republic Act No. (RA) 9165 or the Comprehensive Dangerous Drugs Act of 2002, sentencing them to Life Imprisonment and imposing a fine of PhP 500,000 each; and (2) the crime of using dangerous drugs in violation of Section 15, Article II of RA 9165, sentencing them to rehabilitation in a government institution for one (1) year.
