RAYMAR A. REBALDO V. COMMISION ON ELECTIONS AND WILLIAM S. LACHICA
Sirs/Mesdames:
Quoted hereunder, for your information, is a resolution of the Court En Banc dated June 10, 2008.
G.R. No. 171387 (Raymar A. Rebaldo v. Commision on Elections and William S. Lachica). The present petition for certiorari filed on February 24, 2006 assails the Commission on Elections Resolutions dated February 11, 2005 (First Division) and February 1, 2006 (En Banc) which reversed the order of the Regional Trial Court, Branch 8, Kalibo, Aklan refusing reinstatement of an election protest case involving the May 10, 2004 elections.
Considering that the term of office for Mayor of Kalibo, Aklan which is contested by petitioner had expired on June 30, 2007, and that there appears to be no other issue involved in the petition which is independent from the petitioners claim to the position of Mayor of Kalibo, Aklan, the petition is now moot.
WHEREFORE, the petition is DISMISSED.
