Quoted hereunder, for your information, is a resolution of the Court En Banc dated August 28, 2007

"A.M. No. 04-6-325-RTC.- Re: Creation of Additional Regional Trial Court Branch in the Province of Quezon with Seat at Catanauan.- Considering the Memorandum dated July 30, 2007 of the Office of the Court Administrator (OCA) relative to R.A. No. 9247 which was approved and signed into law on February 19, 2004, entitled "An Act increasing the Number of Regional Trial Court Branches in the Province of Quezon and Lucena City from Thirteen (13) Branches to Fourteen (14) Branches by Creating a New Branch with Seat at Catanauan, Quezon, Amending for the Purpose Subparagraph 8 and Paragraph (e) of Section 14 of Batas Pambansa Bidg. 129", the Court Resolved, upon the recommendation of the OCA, to

(a) IMPLEMENT R.A. No. 9247 by re-numbering and ordering the re-numbering of the Regional Trial Court created thereunder from Regional Trial Court Branch LXXXIII to Regional Trial Court,Branch 96 with seat at Catanauan, Quezon, the authority of the Court to do so being provided for under Sec. 14 of R.A. 7154;

(b) CREATE the following positions and INCLUDE the same in the Personnel Services Itemization of the Regional Trial Court, Branch 96, Catanauan, Quezon to conform with the Staffing Pattern of the Regional Trial Court, to wit:

(c) AMEND Administrative Order No. 7 dated February 11, 1983 under the paragraph province of QUEZON, to read as follows:

QUEZON

1. Branches 53 to 60, inclusive, with seats at Lucena City-comprising Lucena City and the municipalities of Agadangan, Candelaria, Dolores, Lucban, PadreBurgos, Pagbilao, SanAntonio, Sariaya, Tayabas and Tiaong;
   
   
2. Branches 61 to 62 with seats at Gumaca - comprising the Municipalities of Alabat, Atimonan, Gumaca, Macalelon, Perez, Pitogo, Plaridel, Quezon and Unisan;
   
   
3. Branch 63 with seat at Calauag- comprising the Municipalities of Calauag, Guinayangan, Lopez and Tagkawayan;
   
   
4. Branch 64 with seat at Mauban- comprising the Municipalities of Mauban and Sampaloc;
   
   
5. Branch 65 with seat at Infanta- comprising the Municipalities of Burdeos General Nakar, Infanta, Jumalig, Polilio, Panukulan, Patnanungan and Real; and
   
   
6. Branch 96 with seat at Catanauan- comprising the Municipalities of Buenavista, Catanauan, Gen. Luna, Mulanay, San Andres, San Francisco, and San Narciso;
   

(d) DIRECT the Office of Administrative Services, OCA, to SUBMIT to the Department of Budget and Management (DBM), the newly created positions to be included in the Personnel Services Itemization of the RTC for inclusion in the General Appropriations Act for funding purposes;

(e) Thereafter, DIRECT the Financial Management Office, OCA, to SUBMIT to the DBM the funding requirements for the full implementation of R.A. 9247;

(f) DIRECT, the DBM to RELEASE the Supplemental Allotment Release Order (SARO) and the corresponding Notice of Cash Allocation (NCA) for the full implementation of R.A. 9247;

(g) HOLD IN ABEYANCE the organization of the RTC, Branch 96, Catanauan, Quezon, until such time that the DBM has released the aforesaid SARO and NCA;

(h) Pending the organization of the Regional Trial Court, Branch 96, Catanauan, Quezon, the following shall be observed:

a. Cases falling within the jurisdiction of the Regional Trial Court originating from the municipalities of Buenavista, Catanauan, Gen. Luna, Mulanay,SanAndres,SanFranciscoand San Narciso shall continue to be heard in the Regional Trial Court of Gumaca until disposition; and

b.Once a presiding judge has been appointed to Branch 96 together with his staff and has assumed judicial functions, cases falling within the jurisdictionof theRTC originating fromthe aforesaid municipalities shall be filed with Branch 96 provided that:

b.1 The RTC of Gumaca shall continue trying the pending cases under the jurisdiction of Branch 96 already heard by the former unless the parties agree that the cases be transferred to Branch 96; and

b.2 Cases already filed in the RTC of Gumaca but have not yet reached the pre-trial stage in case of civil cases and the accused not yet arraigned in case of criminal cases which are cognizable by Branch 96, shall be unloaded to Branch 96.

(i) AMEND all court records accordingly to conform with this development." Quisumbing, J., on official time.
