A.M. No. 07-7-186-MTC.- Re: Creation of an Additional Branch of the MTC, Daet, Camarines Norte.- The Court Resolved to NOTE the Letter dated May 16, 2007 of Mr. Joaquin C. Lagonera, Senior Deputy Executive Secretary & Acting Head, Office of the President, Presidential Legislative Liaison Officer, transmitting to the Office of the Court Administrator a certified copy of Republic Act No. 9449 entitled An Act Creating an Additional Branch of the Municipal Trial Court in the Municipality of Daet, Province of Camarines Norte, Amending for the Purpose Section 30 of Batas Pambansa Bilang 129, Otherwise Known as the Judiciary Reorganization Act of 1980, as Amended, and Appropriating Funds Therefore.

Considering the enactment of R.A. No. 9449, the Court further Resolved, upon the recommendation of the Office of the Court Administrator, to

1) IMPLEMENT R.A. 9449 by CREATING an additional branch of the Municipal Trial Court of Daet, Camarines Norte, thus denominating the two (2) branches, MTC Branch 1 and Branch 2;

2) CREATE new positions, and TRANSFER the existing position of Clerk of Court II to the OCC to conform with the approved staffing pattern of the Municipal Trial Court consisting of two (2) branches, to wit:

a. CREATION of nineteen (19) new positions to be composed of:

b. TRANSFER one existing position from the Branch to the Office of the Clerk of Court, as follows:

3) DIRECT the Office of Administrative Services, OCA, to SUBMIT to the Department of Budget and Management (DBM) the newly created positions to be included in the Personnel Services Itemization of the MTC for inclusion in the General Appropriations Act for funding purposes;

4) Thereafter, DIRECT the Financial Management Office, OCA, to SUBMIT to DBM the funding requirements for the operation of the newly created branches of the MTC and OCC at Daet, Camarines Norte;

5) DIRECT the DBM to RELEASE the Supplemental Allotment Release Order (SARO) and the corresponding Notice of Cash Allocation (NCA) for the full implementation of R.A. 9449;

6) HOLD IN ABEYANCE the organization of the newly created MTC branch and the Office of the Clerk of Court until such time that the DBM has released the aforesaid SARO and NCA; and

7) AMEND all court records to conform with this development.
