SPOUSES NORMANDY AND RUTH BAUTISTA V. ERNESTO L. SULA

Quoted hereunder, for your information is a resolution of this Court dated 17 October 2007:
A.M. No. P-04-1920 (Spouses Normandy and Ruth Bautista v. Ernesto L. Sula)
In the Decision dated 17 August 2007, the Court found Ernesto L. Sula (Sula), Sheriff IV, Regional Trial Court, Branch 98, Quezon City, guilty of simple misconduct. Accordingly, the Court ordered that Sula be suspended from office for six months without pay. However, in a letter dated 13 September 2007, Sula informed the Court that he was due for compulsory retirement on 18 September 2007. He requested that the penalty of suspension be converted to a fine equivalent to his salary for six months which shall be deducted from his retirement benefits. In view of this development, the dispositive portion of the Decision dated 17 August 2007 is amended to read:

"WHEREFORE, the Court finds Ernesto L. Sula, former Sheriff IV, Regional Trial Court, Branch 98, Quezon City, GUILTY of SIMPLE MISCONDUCT. Accordingly, the Court FINES him an amount equivalent to his salary for six months, to be deducted from his retirement benefits.
SO ORDERED."
