Quoted hereunder, for your information, is a resolution of the Court En Banc dated October 2, 2007

"A.M. No. 07-9-487-RTC.- Re: Report on the Judicial Audit Conducted at the Regional Trial Court, Branch 87, Quezon City.- The Court Resolved, upon the recommendation of the Office of the Court Administrator in its Memorandum dated September 14, 2007, to

I. RE-DOCKET the instant matter as a regular administrative complaint against Ms. Myrla del Pilar Nicandro, Court Stenographer III of RTC, Branch 217, Quezon City and former Officer-in-Charge of RTC, Branch 87, Quezon City;

II. AUTHORIZE the Office of the Court Administrator to refer the matter regarding the alleged bogus/false proof of publications to an OCA consultant for investigation, report and recommendation;

III. BAR Ms. Nicandro from entering and gaining access to court records of RTC, Branch 87, Quezon City pending the investigation;

IV. DIRECT Presiding Judge Teodoro A. Bay of RTC, Branch 86, Quezon City and Pairing Judge of Branch 87, same court, to:

1. DECIDE within ninety (90) days from notice hereof the 8 criminal cases and 2 civil cases submitted for decision, prioritizing those left undecided beyond the reglementary period, to wit: Criminal Case Nos. Q-02-109653, Q-03-122850, Q- 04-11417, Q-04-128804, Q-04-131137, Q-05- 132752, Q-05-132753 & Q-05-135325; Civil Case Nos. Q-03-51113 & Q-04-51672 to submit to the Court certified copies of the decisions/resolutions in the cases aforementioned fifteen days from their promulgation.

2. IMMEDIATELY RESOLVE within ninety (90) days from notice hereof the 7 pending incidents/motions submitted for resolution in the following cases: Civil Case Nos. Q-02-48422, Q-01-44356, Q-03-50936, Q-04-51462, Q-05-56418, Q-05-56752 & Q-06-58754.

3. SUBMIT to the Court certified copies of the decisions/resolutions in the cases aforementioned within fifteen (15) days from their promulgation.

4. IMMEDIATELY TAKE APPROPRIATE ACTION on the following 77 cases which were unacted upon or without further action for a considerable length of time, to wit: Criminal Case Nos. V. DIRECT Victor Pedro A. Yaneza, Legal Researcher II and designated Officer-in-Charge of RTC, Branch 87, Quezon City to:

a. APPRISE and MAKE AVAILABLE to Judge Teodoro A. Bay the records of cases submitted for decision, cases with pending incident submitted for resolution and cases unacted upon for a considerable length of time as mentioned in Item IV (1), (2) & (3) above.

b. SUBMIT a report of the status of the following cases which were not presented to the audit team for examination citing the reasons why it was not so presented, to wit: Criminal Case Nos.
