THE PEOPLE OF THE PHILIPPINES v. WELMOR CUESTA
G.R. No. 198618 (The People of the Philippines v. Welmor Cuesta). - The records of this case were elevated to this Court on September 8, 2011, pursuant to the Court of Appeals Resolution dated July 8, 2011, which gave due course to the notice of appeal filed by accused Welmor Cuesta.
In compliance with the Court's Resolution dated November 16, 2011, both the Office of the Solicitor General and the accused filed their respective manifestations stating that they would no longer be filing their supplemental briefs with this Court and that, instead, they were adopting all the allegations, issues and arguments adduced in their respective briefs filed before the Court of Appeals.
After a careful perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of the accused to sufficiently show reversible error in the challenged decision to warrant the exercise of its appellate jurisdiction.cralaw
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the April 6, 2011 Decision of the Court of Appeals in CA-G.R. CR-H.C. No. 00786, affirming in toto the July 13, 2007 Decision of the Regional Trial Court, Branch 17, Cebu City, in Criminal Case No. CBU-73737, finding the accused, Welmor Cuesta, guilty beyond reasonable doubt of violation of Section 5, Article II of Republic Act No. 9165, and sentencing him to suffer the penalty of life imprisonment and to pay a fine of P500,000.00.
