G.R. No. 200075 (Salic Mapandi v. People of the Philippines).
RESOLUTION
The Court resolves, after a review of the records, to DENY the petition for failure to show any reversible error committed by the Court of Appeals when it upheld the ruling of the RTC that petitioner Mapandi is guilty of violating Section 5 of Republic Act 9165 for selling dangerous drugs to another. This Court finds the main defense of the petitioner that the seized drugs were just planted by the buy-bust team unbelievable. It is noted that the amount of drugs confiscated weighs 16.1 grams and it is contrary to common experience that the team would plant such big amount of drugs just to implicate the petitioner. Moreover, the petitioner failed to prove before the Court that the buy-bust team was inspired by malice which could be the reason for the planting of the evidence. Finally, the Court finds from the records of the case that the prosecution was able to successfully prove all the elements of the crime and that the integrity and evidentiary value of the seized drugs were preserved. cralaw
