PEOPLE OF THE PHILIPPINES v. FOSTER MARAYE Y DACILO
G.R. No. 197538 (People of the Philippines v. Foster Maraye y Dacilo). - The records of this case were elevated to this Court on July 26, 2011, pursuant to the Court of Appeals Resolution dated September 15, 2010 which gave due course to the notice of appeal filed by accused-appellant Foster Maraye y Dacilo.
In compliance with the Court's Resolution dated August 17, 2011, the accused-appellant filed his Supplemental Brief while the Office of the Solicitor General filed a Manifestation and waiver stating that it is no longer filing its Supplemental Brief with this Court; and that it is adopting all the allegations, issues and arguments adduced in its brief filed before the Court of Appeals.
After a perusal of the records of the case, the Court resolves to DISMISS the appeal for failure of the appellant to sufficiently show reversible error in the challenged decision to warrant the exercise of the Court's appellate jurisdiction.cralaw
WHEREFORE, the Court ADOPTS the findings of fact and conclusion of law in the Decision dated January 30, 2008 of the Court of Appeals in CA-G.R. CR-HC No. 03647, finding accused-appellant Foster Maraye y Dacilo guilty beyond reasonable doubt of violation of Section 5, Article II of Republic Act 9165 and is hereby sentenced to suffer life imprisonment and to pay a fine of P500,000.00 without subsidiary imprisonment and to pay the costs.
