RUBEN DE LOS RIOS V. PEOPLE OF THE PHILIPPINES
G.R. No. 181484 (RUBEN DE LOS RIOS v. PEOPLE OF THE PHILIPPINES). - Considering the allegations, issues and arguments presented in the Petition for Review, together with the Comment and the Reply, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated August 24, 2007 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated August 24, 2007 of the Court of Appeals in CA-G.R. CR No. 27921 and AFFIRMS said Decision finding petitioner Ruben De Los Rios y Opis guilty beyond reasonable doubt of the crime of Homicide penalized under the Revised Penal Code, sentencing him to suffer the indeterminate penalty of eight (8) years and one (1) day of prision mayor medium, as minimum, to fourteen (14) years, eight (8) months and one (1) day of reclusion temporal medium, as maximum, and to pay the heirs of the victim the amounts of P50,000.00 as civil indemnity, P50,000.00 as moral damages and P25,000.00 as temperate damages.
