PEOPLE OF THE PHILIPPINES V. DANILO TACABAN Y BABARAN AND EUGENIO TACABAN Y BABARAN
G.R. No. 186414 (People of the Philippines v. Danilo Tacaban y Babaran and Eugenio Tacaban y Babaran - Considering the allegations, issues and arguments presented in the appeal, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed Decision dated July 31, 2008 as to warrant the exercise of the Court's appellate jurisdiction.
IN VIEW OF THE FOREGOING, the Court ADOPTS the findings and conclusions of law in the Decision dated July 31, 2008 of the Court of Appeals in CA-G.R. CR-H.C. No. 02415 and AFFIRMS said Decision finding appellants Danilo Tacaban y Babaran and Eugenio Tacaban y Babaran guilty beyond reasonable doubt of murder, sentencing them to suffer the penalty of reclusion perpetua and to pay the heirs of Nelson Salcedo, jointly and severally, the sum of P50,000.00 as civil indemnity, P50,000.00 as moral damages, and P30,000.00 as actual damages, with MODIFICATION that appellants are ordered to pay the additional amount of P30,000.00 as exemplary damages.
