[G.R. No. 171542 : July 04, 2011]
ANGELITO P. MAGNO V. PEOPLE OF THE PHILIPPINES, MICHAEL MONSOD, ET AL.
G.R. No. 171542 (Angelito P. Magno v. People of the Philippines, Michael Monsod, et al.). - In this motion, petitioner Angelito P. Magno seeks the Court's clarification on the dispositive portion of its April 6, 2011 Decision in the present case, which reads:
WHEREFORE, we DENY the petitioner's petition for review on certiorari, and DECLARE the Amended Decision of the Court of Appeals in CA-G.R. SP No. 79809, promulgated on September 26, 2005, as well as its Resolution of February 6, 2006, NULL AND VOID for having been issued without jurisdiction. The respondents are hereby given fifteen (15) days from the finality of this Decision within which to seek recourse from the Sandiganbayan. No costs.
In that decision, the Court clearly ruled in favor of the petitioner, thereby granting the petition for review. We found that the Court of Appeals erred in taking cognizance of the petition for certiorari, since the Sandiganbayan had jurisdiction over the case. In this light, we hereby clarify the dispositive portion of the decision to read, as follows:
WHEREFORE, we GRANT the petitioner's petition for review on certiorari, and DECLARE the Amended Decision of the Court of Appeals in CA-G.R. No costs.
SO ORDERED.
Very truly yours,
(Sgd.) LUCITA ABJELINA-SORIANO
Clerk of Court
