G.R. No. 197154 (Sulpicio Danseco, Medel Bundang, Alfredo Gayto, et al. v. Paquito Flores, Manuelito Flores and Agnes Flores Espiritu).
RESOLUTION
The Court resolves to DENY the petition there being no reversible error on the part of the Court of Appeals in affirming the Regional Trial Court's Decision dated November 26, 2009. The Municipal Trial Court, Regional Trial Court, and the Court of Appeals unanimously ruled in favor of the respondents and had consistent findings of facts and conclusions of law. Factual findings of the trial court, especially when affirmed by the Court of Appeals, are generally binding and conclusive on the Court for it is not the function of this Court to re-examine the lower court's findings of fact.
As to petitioners' prayer for temporary restraining order or preliminary injunction, the Court resolves to DENY it for lack of merit.
