RODEL PAJARON Y RULL AND JOEL PAJARON Y BELLES V. PEOPLE OF THE PHILIPPINES
Please take notice that the Court, Third Division, issued a Resolution dated 08 August 2011, which reads as follows:
G.R. No. 196778 (RODEL PAJARON y RULL and JOEL PAJARON y BELLES v. PEOPLE OF THE PHILIPPINES); G.R. No. 196876 (NAPOLEON P. SAN JUAN v. PEOPLE OF THE PHILIPPINES). - Considering the allegations, issues and arguments adduced in the petition for review on certiorari assailing the Decision dated January 20, 2011, and Resolution dated April 26, 2011 of the Court of Appeals, Manila, in CA-G.R. CR No. 30465, the Court resolves to DENY the petition for failure to sufficiently show any reversible error in the assailed judgment and AFFIRMS said Decision finding petitioners Rodel Pajaron y Rull, Joel Pajaron y Belles and Napoleon P. San Juan guilty beyond reasonable doubt of the crime of Homicide as defined and penalized under the Revised Penal Code with MODIFICATION that petitioners are hereby sentenced to suffer the indeterminate penalty of 12 years of prision mayor maximum, as minimum, to 14 years, 8 months and 1 day of reclusion temporal medium, as maximum. The award of P50,000.00 as civil indemnity, P50,000.00 as moral damages and P30,585.05 as actual damages to be paid by petitioners jointly and severally to the heirs of the victim, are sustained.
